Hands of Mercy Home Health Care, LLC ensures that all staff comply with HIPAA (Health Insurance Portability and Accountability Act) and other relevant regulations regarding protecting client health information. Violations of these policies will result in disciplinary actions, which may include re-training, warnings, or dismissal. Serious violations could lead to legal consequences. This policy applies to all employees of our organization, including direct hires, trainees, volunteers, contractors, and temporary workers.

TRAINING:

All staff will receive training on HIPAA privacy guidelines during on hire orientation, annually, and whenever there are changes.

  • Violations will be disciplined appropriately, with records of actions maintained.

  • We will investigate and address any security incidents, ensuring no retaliation against reporters.

PRIVACY OFFICER:

Our organization will designate a Privacy Officer to review security incidents, enforce policies, and ensure compliance. Non-compliance will lead to disciplinary actions as per the Sanction Policy.

NOTICE OF PRIVACY PRACTICES:

The HIPAA Privacy Rule mandates that individuals are informed of privacy practices and their rights. Hands of Mercy Home Health Care, LLC will:

  • Provide a privacy notice to every client upon admission.

  • Make the privacy notice available on request and on our website.

  • Distribute revised notices within sixty (60) days of any changes.

  • Notify clients of the privacy notice availability every three (3) years.

The notice will explain:

  • How PHI is used and disclosed.

  • Client rights and how to exercise them.

  • Our legal duties and contact information for privacy concerns.

EMAIL AND TEXTING:

  • When sending ePHI, Organization staff must use secure methods.

  • Clients can send health information via non-secure methods, but it becomes protected under HIPAA when received by the Organization.

  • Staff will use encrypted email systems for PHI and will not send PHI via text.
